SECTION 83.2003. Attempted Evasion of Applicability of Subchapter

A "device, subterfuge, or pretense to evade the application of this subchapter," as used in Texas Finance Code, §393.602(c), includes:
(1) a transaction that is not identified as a deferred presentment transaction or payday loan, if the transaction is a deferred presentment transaction; and (2) a transaction that is not identified as a motor vehicle title loan, if the transaction is a motor vehicle title loan.
