SECTION 9.131. Definitions

The following words and terms, when used in this subchapter, shall have the following meanings, unless the context clearly indicates otherwise.
(1) Executive director--The executive director of the Texas Department of Transportation. (2) Grant--An award of funds or property in lieu of funds made by the department to a grantee or by the grantee to another individual or entity. The term does not include: (A) procurement purchases; (B) technical assistance; (C) assistance in the form of revenue sharing, loans, loan guarantees, interest subsidies, or insurance; (D) assistance for which no accounting by the grantee is required; or (E) payments that are made to a contractor for the purpose of obtaining goods and services and that create a procurement relationship between the department and the contractor. (3) Grantee--An individual or entity to which a grant is awarded. The term includes an individual or entity that receives an award that is for the purpose of carrying out a part of a federal or state award and that creates a federal or state assistance relationship between the department and that individual or entity.
