SECTION 7.94. Escalation of Enforcement Action

(a) If a rail transit agency fails to comply with an administrative action notification, the department will notify the executive director. (b) The executive director will notify the rail transit agency's governing body of the violation and the failure of the rail transit agency's correction of the violation. (c) Within 45 days after the date on which the rail transit agency's governing body receives notice under subsection (b) of this section, the governing body shall provide to the executive director evidence that the violation has been resolved. (d) If the rail transit agency's governing body is unable to show that the corrective action has been satisfactorily completed, the department shall rescind approval of the rail transit agency's system safety program plan. (e) If the department rescinds approval of a rail transit agency's system safety program plan, the department may petition a court of competent jurisdiction to halt the operation of the rail transit agency's rail fixed guideway system program.
