(a) The record in a contested case includes the matters listed in the APA, Government Code, §2001.060. (b) Proceedings, or any part of them, shall be transcribed on written request of any party. The party requesting the proceeding to be transcribed shall make the initial payment for the transcription. Ultimately, however, the commission or Agency Chief has the authority to assess, in addition to an administrative penalty, the costs of transcribing the administrative hearing. (c) Appeal. The costs of transcribing the testimony and preparing the record for an appeal by judicial review shall be paid by the party who appeals.
