SECTION 334.304. Who May File Application

Only the following person may file an application for reimbursement under this subchapter:
(1) the eligible owner of a tank from which a release has occurred and for which partial or completed corrective action has been performed, or his duly authorized agent; (2) the eligible operator of a tank from which a release has occurred and for which partial or completed corrective action has been performed, or his duly authorized agent; (3) an owner or operator ordered by the commission or required in a written corrective action directive by the agency staff on or after September 1, 1987, to assess the nature and extent of contamination in cases where no release is discovered, or the duly authorized agent of such owner or operator; or (4) a past owner or operator who, in response to a release, performed corrective action on or after September 1, 1987.
