SECTION 4.1605. Eligibility Requirements

An eligible policy that is subject to this subchapter must be reinstated, without evidence of insurability, on payment of past due premiums and interest if it meets the following requirements:
(1) it has been in force continuously for at least five years immediately before the date of lapse; (2) all premiums have been paid during such period, or within the grace period; (3) there is a subsequent unintentional default in premium payments caused by the mental incapacity of the insured; and (4) proof and request for reinstatement are submitted within one year from the date of lapse.
