SECTION 3.3001. Applicability and Scope

(a) Unless otherwise specified, this subchapter applies to all individual accident and sickness insurance policies and subscriber contracts of hospital and medical and dental service associations, delivered, issued for delivery, or renewed in this state on and after the effective date of this section, except they do not apply to individual policies or contracts issued pursuant to a conversion privilege under a policy or contract of group insurance; individual policies issued pursuant to a conversion privilege under an individual policy delivered or issued for delivery in this state prior to January 1, 1978; policies issued to employees or members as additions to franchise plans in existence on January 26, 1977; or credit accident and sickness insurance policies written under Insurance Code Chapter 1153. Individual accident and sickness insurance policies and subscriber contracts of hospital and medical and dental service associations, delivered, issued for delivery, or renewed in this state prior to the effective date of this section are subject to the regulations in effect at the time the policy or contract was delivered, issued for delivery, or renewed. (b) The requirements contained in this subchapter are in addition to any other applicable regulations previously adopted; however, this subchapter governs wherein any conflict or difference exists. The provisions of applicable statutes govern where ambiguity or difference exists between this subchapter and such statutes.
