SECTION 558.604. Surrender or Expiration of a License

(a) After a survey in which a surveyor cited deficiencies, an agency may surrender its license or allow its license to expire to avoid enforcement action by HHSC. (b) If an agency surrenders its license before the expiration date, the agency must return its original license and provide the following information to HHSC: (1) the effective date of closure; (2) the location of client records; (3) the name and address of the client record custodian; (4) a statement signed and dated by the license holder agreeing to the surrender of the license; and (5) the disposition of active clients at the time of closure. (c) If an agency surrenders its license or allows its license to expire, HHSC denies an application for license by the agency, its license holder, and its affiliate for one year after the date of the surrender or expiration.
