SECTION 558.292. Agency and Client Agreement and Disclosure

(a) The agency must provide the client or the client's family with a written agreement for services. The agency must comply with the terms of the agreement. The agreement must include at a minimum the following: (1) notification of client rights; (2) documentation concerning notification to the client of the availability of medical power of attorney for health care, advance directive or "Do Not Resuscitate" orders in accordance with the applicable law; (3) services to be provided; (4) supervision by the agency of services provided; (5) agency charges for services rendered if the charges will be paid in full or in part by the client or the client's family, or on request; (6) a written statement containing procedures for filing a complaint in accordance with §558.282(d) of this division (relating to Client Conduct and Responsibility and Client Rights); and (7) a client agreement to and acknowledgement of services by home health medication aides, if home health medication aides are used. (b) The agency must obtain an acknowledgment of receipt from the client or his family of the items listed under subsection (a) of this section. This acknowledgment of receipt must be kept in the client's record.
