HHSC refers a facility to the Office of the Attorney General or local prosecuting authority for a temporary restraining order or an injunction when:
(1) a violation creates an immediate threat or threat to the health and safety of residents; (2) a facility is operating without a license; or (3) HHSC is denied entry to a facility that is alleged to be operating without a license.
