(a) The purpose of this chapter is to establish: (1) the criteria and application procedure for licensing an assisted living facility; (2) the licensing standards with which an assisted living facility must comply and that serve as a basis for licensure inspections, including: (A) operation and resident care standards; and (B) facility construction standards; (3) the inspections and investigations HHSC may conduct as a regulatory authority; and (4) enforcement actions HHSC may take against a facility. (b) This chapter applies to a facility licensed or subject to being licensed in accordance with Texas Health and Safety Code, Chapter 247. Assisted living services are driven by a philosophy that emphasizes personal dignity and autonomy to age in place in a residential setting while receiving increasing or decreasing levels of services as the person's needs change.
