SECTION 361.61. Qualifications and Training Requirements for Volunteers of Contractors

(a) A contractor that uses a volunteer who is not a certified guardian must ensure that the volunteer does not perform guardianship duties, but the volunteer may provide services that a DADS volunteer may provide under Texas Human Resources Code §161.114(c). (b) A contractor that uses a volunteer must: (1) provide training that is relevant to the services the volunteer will provide; (2) assign to the volunteer a supervisor who is a certified guardian and an employee of the contractor; (3) ensure that the volunteer does not provide services to a DADS ward until documentation and observation indicate the volunteer is qualified to work with the ward; (4) ensure that the volunteer's supervisor reviews all work completed by the volunteer; (5) ensure that the volunteer's supervisor countersigns all documentation completed by the volunteer; (6) ensure that the volunteer's supervisor meets with the volunteer at least once per month and documents the meeting; (7) ensure that the volunteer protects the health and safety of the ward; (8) provide additional training to the volunteer on skills needed to provide services at least annually; and (9) document training provided to the volunteer.
