SECTION 376.237. Can a contractor subcontract services?

Yes. A contractor may subcontract services with the following provisions:
(1) The Texas Department of Human Services (DHS) must approve the subcontract. (2) The contractor must agree to be responsible for the satisfactory performance of its subcontractor(s) and routinely monitor the subcontractor(s) for fiscal and programmatic compliance. (3) All subcontractors are subject to the same requirements as the contractor. (4) DHS must give prior approval for all subcontractors.
