SECTION 354.2333. Waiver Authority of the Executive Commissioner

(a) The Executive Commissioner has the authority to waive all or part of the state's right to recover from liable third party resources when the Executive Commissioner finds that enforcement of the state's right of recovery would tend to defeat the purpose of public assistance. (b) The Executive Commissioner has the authority to waive all or part of the federal matching share of HHSC's right to recovery from liable third party resources only if the cost of recovery exceeds the amount, which could be recovered.
