SECTION 213.35. Functional Performance Criteria

Effective April 18, 2020 unless an exception is approved by the president or chancellor of an institution of higher education or an exemption has been made for specific technologies pursuant to 1 Texas Administrative Code §213.37, all EIR developed, procured, or changed by an institution of higher education shall comply with the standards described in this subchapter. To the extent that an EIR does not comply with the requirements of 1 Texas Administrative Code §213.30 - 213.33 that are applicable to that EIR, the noncompliant features of that EIR shall conform to the standards referenced in Section 508 Appendix C, Chapter 3, §302 Functional Performance Criteria.
