SECTION 83.22. License Requirements--Establishments

(a) To be eligible for an establishment license, an applicant must: (1) obtain the current law and rules book; (2) comply with the requirements of the Act and this chapter; (3) submit a completed and verified application in the manner prescribed by the department; (4) pay the fee required under §83.80; (5) own or rent the establishment; and (6) have not committed an act that constitutes a ground for denial of a license. (b) In addition to the requirements of subsection (a), the establishment must: (1) meet this chapter's minimum health and safety standards for an establishment; and (2) comply with all requirements of this chapter. (c) In addition to the requirements of subsection (a) and (b), a mobile establishment license applicant must: (1) provide a permanent physical address from which the mobile establishment unit is dispatched and to which the mobile establishment unit is returned when not in use; (2) provide a permanent mailing address where correspondence from the department may be received; and (3) verify that the mobile establishment complies with the requirements of the Act and this chapter.
