(a) Any party that disagrees with the findings and decision of an IHO has a right to bring a civil action in any court of competent jurisdiction without regard to the amount in controversy, consistent with 34 CFR §361.57(i). (b) An individual must initiate a civil action for review of an IHO's decision by filing a petition not later than the 30th day after the date on which the decision that is the subject of complaint is final and appealable.
