SECTION 705.701. Who is eligible for emergency protective services?

Emergency protective services may be provided to an alleged victim who is also the subject of an investigation conducted by HHSC PI and:
(1) receives services from a provider as defined by Texas Human Resources Code, §48.251(a)(9); or (2) lives in a residence that is owned, operated or controlled by a provider of home and community-based services under the home and community-based services waiver program described by Texas Government Code, §534.001(11)(B), regardless of whether the alleged victim is receiving services under that waiver program from the provider.
