SECTION 705.103. How is abuse defined?

In this chapter, when the alleged perpetrator is a caretaker, family member, or other person who has an ongoing relationship with the alleged victim, abuse is defined as:
(1) the negligent or willful infliction of injury, unreasonable confinement, intimidation, or cruel punishment with resulting physical or emotional harm or pain to the alleged victim; or (2) sexual abuse of the alleged victim, including any involuntary or nonconsensual sexual conduct that would constitute an offense under Texas Penal Code, Section 21.08, (indecent exposure) or Texas Penal Code, Chapter 22, Assaultive Offenses.
