SECTION 355.400. Policy, Procedure, and Practice

The governing board of the facility shall require that written policies and procedures exist governing the operation of all non-secure juvenile correctional facilities in the county or district, as applicable. The policies, procedures, and practices of the facility shall include:
(1) a policy that strictly prohibits the following: (A) physical, sexual or emotional abuse, neglect, or exploitation of a resident by any individual having contact with a resident of the facility; (B) youth-on-youth sexual conduct between residents; (C) violations of the juvenile justice professionals' code of ethics as outlined in Chapter 345 of this title; (D) violations of any professional code of ethics or code of conduct by any individual providing services to or having contact with residents of the facility; and (2) a zero-tolerance policy and practice regarding sexual abuse in accordance with the Prison Rape Elimination Act of 2003 that provide for administrative and/or criminal disciplinary sanctions.
