SECTION 349.320. Notice and Service

(a) Notice must be in writing and addressed to the Certified Officer. Notice to a Certified Officer is effective and service is complete when sent by certified mail, return receipt requested, to the Certified Officer's most recent address of record with the Commission. (b) If a document was sent by regular or certified mail, it will be presumed received no later than three days after mailing. Service shall be presumed effected if the wrapper containing the document is not returned to the Commission. (c) Notice of a hearing in a contested case must comply with §2001.052 (APA) of the Texas Government Code. Service is complete when made pursuant to 1 TAC §155.103 (SOAH Procedural Rules).
