SECTION 28.81. Sample Collection by Community Supervision Agency

The following individuals shall provide one or more DNA samples taken by or at the request of a community supervision and corrections department or a local juvenile probation department ("supervising agency") for the purpose of creating a DNA record:
(1) an individual, other than a juvenile, who is ordered by a magistrate or court to provide a DNA sample under Code of Criminal Procedure, Article 42.12 or other law as part of an order granting community supervision to the individual; and (2) a juvenile who, following an adjudication for conduct constituting a felony, is placed on probation, if the conduct constitutes a felony described by Family Code, §54.0409.
