SECTION 33.6. Power of Attorney

(a) Teacher Retirement System of Texas (TRS) acknowledges the authority of an attorney in fact under a power of attorney that is durable and meets the requirements of the laws and rules in effect at the time the power of attorney was executed. (b) A power of attorney is considered durable if it contains a statement showing the principal's intent that the authority of the attorney in fact may be exercised in the event of the principal's subsequent incapacity or disability. (c) The authority of an attorney in fact under a durable power of attorney or a statutory durable power of attorney is acknowledged by TRS to the extent the authority is granted in the power of attorney.
