SECTION 1.378. Qualifications and Immunity of the Mediator

(a) The mediator shall possess the qualifications that are required under Civil Practice and Remedies Code, §154.052; be subject to the standards and duties that are prescribed by Civil Practice and Remedies Code, §154.053; and have the qualified immunity that is stated in Civil Practice and Remedies Code, §154.055, if applicable. (b) The parties should decide whether, and to what extent, knowledge of the subject matter and experience in mediation should be considered as preferred qualities of the mediator. (c) The parties should obtain from the prospective mediator the ethical standards that will govern the mediation.
