SECTION 58.357. Amendment

(a) The department may amend a permit issued under the provisions of this subchapter, provided the permittee: (1) has submitted an administratively complete application for permit amendment on a form provided or approved by the department; and (2) possesses all necessary authorizations and permits required by any other state or federal entity for the conduct of activities contemplated in the permit amendment. (b) The department will not approve an amendment to increase the size of a permitted area. A permittee who seeks to increase the size of a permitted area must apply for a new permit and all provisions of this subchapter relating to permit applications apply. (c) An expired permit is not eligible for permit amendment. Source Note: The provisions of this §58.357 adopted to be effective August 24, 2020, 45 TexReg 5916
