SECTION 363.1311. Rural and Water Conservation Reporting

(a) After the loan closing of a project and release of funds to the political subdivision, the executive administrator shall determine what portion of the project funds, if any, qualify as funding for: (1) rural political subdivisions; (2) agricultural water conservation; (3) water conservation, including agricultural irrigation projects designed for water conservation; or (4) reuse, including agricultural irrigation projects designed for reuse. (b) For project costs that cannot be assigned to either a qualifying category and non-qualifying portions of the project, the executive administrator will allocate costs proportionately. (c) The executive administrator will include in the biennial report to the Legislature required by Texas Water Code §15.440, the percentage of SWIFT and SWIRFT funds used to support rural political subdivisions and agricultural water conservation, and the percentage of SWIFT and SWIRFT funds used to support water conservation or reuse, including agricultural irrigation projects, that are designed for water conservation or reuse. The executive administrator will post this information on the board's internet website along with an explanation for the allocation.
