SECTION 25.5. Responsibilities

(a) It is the responsibility of the state through the agency to provide assistance to local governments in the cleaning of public beaches. For purposes of this section, assistance includes, but is not limited to, the following: (1) Awards made under this program; (2) Cleaning and maintaining public beaches, at the sole discretion of the GLO, to maintain the public beach easement; and (3) Cleaning, maintenance and debris removal from a public beach that is located in an area designated as a threatened area in a declaration of a state of disaster issued under §418.014 of the Government Code. (b) It is the responsibility of the governing body of any incorporated city, town, or village bordering the Gulf of Mexico to clean and maintain public beaches as provided in Natural Resources Code §61.065. (c) It is the responsibility of the commissioners court of any county bordering on the Gulf of Mexico to clean and maintain public beaches as provided in Natural Resources Code §61.066. (d) The responsibility for inspection by the agency is vested in the designated agency field office in the area. (1) The designated field office will conduct routine inspection of the area under its authority. (2) The designated field office will furnish a report of inspection activities and any public comment received by the field office concerning beach maintenance. This report will be a general summary as to the method, quality, frequency, and acceptability to which the public beaches are being cleaned and maintained by the participant. Problem areas, repeat discrepancies, and safety hazards will be given special emphasis.
