SECTION 17.33. Introduction of Exhibits

  • Exhibits of documentary character shall not unduly encumber the files and records of the General Land Office.

    (1) Tender and service. Where practical, the original of each exhibit offered shall be tendered to the examiner for identification. At the discretion of the examiner, a copy of an original exhibit may be accepted in lieu of the original. One copy shall be furnished to the examiner and one copy shall be furnished to each party of record or its representative. Written or printed documents and maps received in evidence may not be withdrawn except with the approval of the examiner.

    (2) Excluded exhibits. If an exhibit is identified, objected to, and excluded, the party offering the exhibit may withdraw the exhibit and the examiner may permit its return. If the excluded exhibit is not withdrawn, it shall be identified, endorsed with the examiner's ruling, and included in the record for the limited purpose of preserving an exception to the examiner's ruling.
