SECTION 15.30. Certification Status of City of South Padre Island Dune Protection and Beach Access Plan

(a) The City of South Padre Island has submitted to the General Land Office a dune protection and beach access plan (plan) which is certified as consistent with state law. The plan was adopted on October 5, 1994. (b) The General Land Office certifies that the amendment to the plan adopted by the Board of Aldermen on May 7, 2003, is consistent with state law. (c) The General Land Office further certifies that the amendment to the plan adopted by the Board of Aldermen as Ordinance No. 05-07 on May 4, 2005, is consistent with state law. (d) The General Land Office certifies that the amendment to the plan adopted by the City Council as Ordinance No. 12-09 on August 1, 2012, is consistent with state law. The Ordinance amended the plan by adding the City of South Padre Island Erosion Response Plan as an appendix to the plan. (e) The General Land Office certifies that the Beach User Fee and the Beach User Fee Plan adopted by the City Council in Ordinance Number 15-06 on May 20, 2015 is consistent with state law. The Plan adopts a Beach User Fee of up to $13.00 dollars a day and an annual fee of up to $50.00.
