SECTION 35.12. Authority of Executive Director

(a) The executive director may receive applications and issue emergency orders under this chapter. If an emergency order is issued without notice and a hearing, notice shall be issued and a hearing by the commission to affirm, modify, or set aside shall be set. If a hearing request is received, and the commission grants the request, the commission shall either hold a contested case hearing, or remand the case to SOAH. (b) The executive director may authorize, in writing, a representative or representatives to act on the executive director's behalf under this chapter.
