SECTION 3.3802. Purpose

The purpose of this subchapter is to implement the Insurance Code Chapter 1651:
(1) to promote the public interest; (2) to promote the availability of long-term care insurance coverage; (3) to protect applicants for long-term care insurance, as defined, from unfair or deceptive sales or enrollment practices; (4) to facilitate public understanding and comparison of long-term care insurance coverages; (5) to facilitate flexibility and innovation in the development of long-term care insurance; (6) to allow the sale of long-term care insurance contracts which will qualify insureds, under certain conditions, for favorable tax treatment under federal law; and (7) to adopt, in consultation with the Texas Health and Human Services Commission, minimum standards for a long-term care benefit plan that may qualify as an approved plan under the long-term care partnership program.
