(a) Notice to applicant. Within 40 days from receipt of an application for an agent's license, the agency shall determine an application to be complete or deficient for purposes of submission for review and shall issue written notice to the applicant regarding the status of the application. (1) Complete application. (A) The written notice for a complete application shall state that the application is complete and accepted for filing for review as of the date of its receipt and shall include the information contained in subsections (b) and (c)(2) of this section, unless such information has previously been furnished to the applicant. (B) For purposes of this section, an application is complete upon agency determination that it is in compliance with the content and form prescribed for submission for review by the agency. (2) Deficient application. (A) The written notice for a deficient application shall state that the application is not complete, set out the specific additional information that is required for completion, and include the information contained in subsection (c) (1) of this section. After one written notice of deficiency has been issued, another is not required for an application resubmitted in whole or in part with deficiencies. (B) In addition to notice issued under subparagraph (A) of this paragraph, the agency may notify the applicant, in any manner, of deficiencies in the application. (b) Processing of application. (1) No examination required. Within 40 days after receipt of a complete application for which no examination is required, the agency shall grant the license or give notice of denial to the applicant. (2) Examination required. (A) Within 40 days after the filing of an applicant's passing examination score, the agency shall grant the license or give notice of denial to the applicant, except as provided in paragraph (3) of this subsection. (B) An examination score is filed with the agency at the time the examination is completed by the applicant or is received by the agency from an independent grading service, whichever is later. (3) HMO agent's license. Pursuant to §11.404 of this title (relating to Application for License Prior to Certificate of Authority), an applicant for an HMO agent's license shall not be issued a license until after a certificate of authority has been granted to the applicant's appointing HMO. (c) Application disapproved. (1) An application which is not complete within 180 days of the date of its receipt may be disapproved. (2) An application for which an examination is required may be disapproved if a passing examination score is not on file with the agency within 180 days from receipt of the application.
