SECTION 965.9. Reporting Abuse, Neglect, or Exploitation

(a) If, based on a person's viewing of or listening to a recording obtained through electronic monitoring, the person has cause to believe that an individual is in a state of abuse, neglect, or exploitation or has been abused, neglected, or exploited, the person must: (1) report the suspected or known abuse, neglect, or exploitation to the Texas Health and Human Services Commission Provider Investigations (HHSC-PI) and the director of the facility in which the alleged abuse, neglect, or exploitation occurred immediately, if possible, but in no case more than one hour after the person knows or suspects that abuse, neglect, or exploitation has occurred; and (2) provide the original tape or recording to HHSC-PI. (b) A person who sends more than one tape or recording to HHSC-PI must identify each tape or recording on which the person believes an incident of abuse or exploitation or evidence of neglect may be found. A person is encouraged to identify the place on the tape or recording where an incident of abuse or exploitation or evidence of neglect may be found.
