SECTION 745.907. What are the consequences of Licensing designating me as a controlling person?

(a) If we designate you as a controlling person: (1) We may not issue you a permit to operate a child-care operation for five years after our designation is sustained; and (2) You may not be the controlling person at a child-care operation for five years after the designation is sustained. (b) Our designation of you as a controlling person is sustained when the revocation or voluntary closure described in §745.905 of this title (relating to When will Licensing designate someone at my child-care operation as a controlling person?) is final and: (1) You have waived your due process rights regarding the designation; or (2) The designation is upheld after you have exhausted your due process rights. (c) Another state agency may deny your application for a permit based on information obtained from us, as outlined in Chapter 531 of the Government Code, Subchapter W (relating to Adverse Licensing, Listing, or Registration Decisions).
