SECTION 307.51. Purpose and Application

(a) The purpose of this subchapter is to implement the Home and Community-Based Services--Adult Mental Health (HCBS-AMH) program, providing home and community-based services to individuals with a serious mental illness who are eligible for or currently receiving Medicaid in accordance with the Medicaid state plan and applicable state legislative direction. (b) The subchapter applies to: (1) a person or entity contracting with HHSC to provide HCBS-AMH services, as described in this subchapter; (2) an entity having administrative responsibilities under this program; and (3) an individual applying for or enrolled in the HCBS-AMH program.
