(a) An OCR provider must: (1) inform the individual receiving OCR services of the individual's rights in accordance with 25 TAC Chapter 404, Subchapter E (relating to Rights of Persons Receiving Mental Health Services) or 40 TAC Chapter 4, Subchapter C (relating to Rights of Individuals with an Intellectual Disability), as applicable; (2) provide the individual with a copy of the rights handbook published for an individual receiving mental health services or an individual with an ID; and (3) explain to the individual receiving OCR services how to initiate a complaint and how to contact: (A) the Ombudsman for complaints against the OCR provider; and (B) the Texas protection and advocacy agency. (b) The individual may contact the Ombudsman for additional information and resources, at any time, by calling toll-free at 1-800-252-8154 or online at hhs.texas.gov/ombudsman.
