SECTION 260.257. Individual's Access to Personal Funds

When an individual whose personal funds are maintained in a trust fund account requests disbursement of a portion or all of the personal funds, a program provider must:
(1) determine if the individual has a sufficient amount of personal funds on deposit in the trust fund account to cover the requested disbursement; (2) if the individual has a sufficient amount of personal funds on deposit in the trust fund account, provide the individual with requested funds within 72 hours after receiving the request; and (3) if the individual does not have a sufficient amount of personal funds on deposit in the trust fund account, notify the individual, in writing, that the individual does not have sufficient personal funds in the trust fund.
