SECTION 110.13. Motion for Rehearing

(a) A party may file a motion for rehearing in accordance with Texas Government Code 2001 §146(a). (b) A party must file a reply to a motion for rehearing in accordance with Texas Government Code 2001 §146(b). (c) The Texas Health and Human Services Commission (HHSC) Executive Commissioner or the Executive Commissioner's designee shall act on a motion for rehearing not later than the 55th day after the date the decision that is the subject of the motion is signed or the motion for rehearing is overruled by operation of law in accordance with Texas Government Code 2001 §146(c).
