SECTION 414.505. Obtaining or Requesting Criminal History Record Information and Checking Registry

(a) Facilities must obtain criminal history record information directly from the Texas Department of Public Safety (TDPS) by contacting Crime Records Services, TDPS, P.O. Box 4143, Austin, TX 78765-4143. (b) Local authorities and community centers may: (1) pay a private agency to obtain criminal history record information directly from TDPS; or (2) obtain criminal history record information directly from the Texas Department of Public Safety (TDPS) by contacting Crime Records Services, TDPS, P.O. Box 4143, Austin, TX 78765-4143. (c) In addition to obtaining criminal history record information from TDPS, facilities, local authorities, community centers, and providers must obtain criminal history information for applicants who have lived outside the State of Texas at any time during the two years preceding the application for employment/volunteer status through the FBI using a complete set of fingerprints on the official FBI card. The FBI charges for this information. The official FBI card may be obtained from Human Resource Services, TDMHMR, P.O. Box 12668, Austin, TX 78711-2668. (d) A provider that is not required to conduct criminal history clearances in accordance with the Texas Health and Safety Code, Chapter 250, must obtain criminal history record information through the facility, local authority, or community center with which it contracts. (e) Facilities, local authorities, community centers, and providers must check the Employee Misconduct Registry and the Nurse Aide Registry by calling 1-800-452-3934.
