SECTION 411.64. Memorandum of Understanding (MOU) on Relocation Pilot Program

(a) Texas Department of Mental Health and Mental Retardation (TDMHMR) adopts by reference a rule of the Texas Department of Human Services (TDHS) contained in 40 TAC §72.104 (relating to Memorandum of Understanding on Relocation Pilot Program). (b) The TDHS rule contains the text of a memorandum of understanding (MOU) between: (1) TDMHMR; (2) TDHS; and (3) Texas Department of Protective and Regulatory Services. (c) The MOU is required by Texas Human Resources Code, §22.038. It requires the three agencies to coordinate and implement a pilot program, subject to availability of funds, to provide a system of services and supports that fosters independence and productivity and provides meaningful opportunities for persons with disabilities to live in the community. The terms of the MOU apply in those areas of the state in which community awareness and relocation pilot programs will be implemented. (d) Copies of the MOU are filed in the Office of Policy Development, TDMHMR, 909 West 45th Street, Austin, Texas 78756, and may be reviewed during regular business hours.
