(a) The provisions of this subchapter apply to all organizations and individuals providing electroconvulsive therapy on an inpatient or outpatient basis, in or on a contractual basis with: (1) all facilities of the Texas Department of Mental Health and Mental Retardation; (2) community mental health and mental retardation centers; (3) psychiatric hospitals licensed by the Texas Department of Health under the Health and Safety Code, Chapter 577; and (4) psychiatric units of hospitals licensed by the Texas Department of Health under the Health and Safety Code, Chapter 241. (b) Pursuant to the Health and Safety Code, Title 7, Subtitle C, Chapter 578, the following provisions of this subchapter apply to all organizations and individuals administering ECT in Texas: (1) §405.104 of this title (relating to General Requirements); (2) §405.108 of this title (relating to Informed Consent to ECT); (3) §405.112(b) of this title (relating to Report of Electroconvulsive Therapy); (4) §405.114 of this title (relating to Registration of ECT Stimulus Apparatus); and (5) §405.115 of this title (relating to Enforcement and Penalties).
