SECTION 146.2. Applicability and Exemption

(a) The provisions of this chapter apply to: (1) a training program that delivers a certified training curriculum for promotores or community health workers; (2) an instructor representing that the instructor trains promotores or community health workers; or (3) a promotor(a) or community health worker representing that the promotor(a) or community health worker performs as a certified promotor(a) or community health worker. (b) Certification under this chapter is voluntary for a promotor(a) or community health worker who provides services without receiving compensation and mandatory for a promotor(a) or community health worker who provides services for compensation. (c) Application and certification procedures are outlined in policy and can be found online at www.dshs.texas.gov. (d) The department or commission may develop a specialty certification and continuing education for promotores or community health workers or instructors that may be certified by the department directly.
