SECTION 882.40. Criminal History Background Checks

(a) Before the Council will issue a license, an applicant must undergo a fingerprint-based criminal history record check. (b) The Council may require a licensee to obtain an updated fingerprint-based criminal history record check at any time. (c) A licensee who was not required to undergo a fingerprint based criminal history record check as a condition of licensure, must undergo a fingerprint based criminal history check if directed by the Council as a condition for renewal of a license. A licensee may fulfill all other renewal requirements, but a report must be received by the Council from the Texas Department of Public Safety and the Federal Bureau of Investigation before a license will be renewed. (d) Applicants and licensees who hold a license issued by the Council or one of its member boards, and who underwent a fingerprint-based criminal history record check as part of the licensing process for that license, do not need to undergo another check.
