(a) The board shall arrange for a stenographic recording of all contested case hearings before the State Office of Administrative Hearings on a regular basis. The administrative law judge may waive the requirement as authorized by the State Office of Administrative Hearings Rules of Procedure. Any party may request a written transcript of all or part of the hearing. The cost of a transcript shall be paid by the requesting party. (b) A party who appeals a final decision in a hearing shall pay the cost of preparation of the original or a certified copy of the record of the board proceeding that is required to be sent to the reviewing court. A charge imposed under this section is a court cost and may be assessed by the court in accordance with the Texas Rules of Civil Procedure.
