SECTION 93.61. Inclusion in Application

(a) The application must include at least three specimens or examples of use of the mark, including at least one specimen per class in which registration is sought. The specimen must show the mark as it is used on or in connection with the goods and/or services in Texas. (b) If a specimen supports multiple classes, the applicant should indicate which classes are supported by the specimen. (c) A specimen which is merely a printer's proof or reproduction of the drawing submitted to comply with §93.51 of this title (relating to Drawing Required) will not be considered to be a specimen of the mark in use.
