SECTION 93.24. Requirements for Receiving a Registration Date

A mark registrable under §16.051 of the Business & Commerce Code will receive a registration date only if each of the following items is received and found to comply with the requirements of the Code and this chapter:
(1) written application for registration that complies with Subchapter D of this chapter (relating to the Written Application); (2) a drawing of the mark that complies with Subchapter E of this chapter (relating to Drawing); (3) at least three specimens of the mark as actually used, that comply with Subchapter F of this chapter (relating to Specimens), including at least one specimen per class; and (4) the application fee for each class of goods and/or services, as required by §93.151 of this title (relating to Recordation Fees).
