SECTION 93.141. Voluntary Cancellation

(a) The Secretary of State may cancel a registration upon receipt of a sworn request in writing for cancellation executed by the registrant or registrant's assignee of record. The request must include the following: (1) the mark to be cancelled, registration number, and date registered; (2) the name and address of the registrant; and (3) a statement as to the classes sought to be cancelled, or if registrant seeks to cancel the registration in its entirety, a statement to that effect. (b) The request for cancellation should be accompanied by: (1) the certificate of registration; or (2) the registrant's statement that the certificate has been lost. (c) If fewer than all classes are cancelled, the Secretary of State will update the computer records to reflect the classes cancelled. A correct certificate of registration is available upon request by complying with §93.113 of this title (relating to Issuance of a Corrected Certificate).
