SECTION 62.1. Scope and Construction of Rules

(a) This subchapter is intended to apply to the administration of the Sexual Assault Nurse Examiner Certification under the Sexual Assault Prevention and Crisis Services (SAPCS) Act, Texas Government Code, Chapter 420. (b) If good cause is established to show that compliance with any part of this subchapter may result in an injustice to any party, these rules may be waived at the discretion of the chief. (c) The Office of the Attorney General (OAG) may review, audit, or investigate any information submitted by any individual or entity pursuant to this subchapter. (d) This subchapter is intended to effectuate the purpose of Texas Government Code, Chapter 420 regarding the minimum standards for the certification, suspension, decertification or probation of a sexual assault nurse examiner (SANE), the standards for examiner training courses, and for the interstate reciprocity of SANEs. (e) These are the minimum standards and are not intended to represent the best possible practices or highest possible standards of a SANE.
