(a) The authority for this designation procedure rests in the Federal-Aid Highway Act of 1973, section 112. Section 112 states in part that: "funds apportioned to any State . . . . be made available by the State to the metropolitan planning organizations designated by the State as being responsible for carrying out the provisions of Section 134. . . ." (b) Section 134 of Chapter 1 of Title 23, United States Code, required each state to establish and maintain in its urban areas a continuing comprehensive transportation planning process carried on cooperatively by states and local communities. Section 134 was added to Title 23 by the Federal-Aid Highway Act of 1962 and has been a requirement for receipt of Federal Highway Funds since 1966.
