SECTION 55.308. Confidentiality and Security

(a) Confidentiality of Records. The records contained in the new hire directory shall be confidential and may be accessed for the following purposes only: (1) Location of Child Support Obligors. The Title IV-D Agency shall use the Employer New Hire Reporting (ENHR) information to locate individuals for purposes of establishing paternity and establishing, modifying, and enforcing child support obligations, and may disclose such information to any agent of the agency that is under contract with the agency to carry out such purposes. (2) Verification of Eligibility for Certain Programs. A State agency responsible for administering a program specified in section 1137(b) of the Social Security Act shall have access to information reported by employers for purposes of verifying eligibility for the program. (3) Administration of Employment Security and Workers' Compensation. State agencies operating employment security and workers' compensation programs shall have access to ENHR information reported by employers for the purposes of administering such programs. (b) Security. The State IV-D agency shall have in effect safeguards on the integrity, accuracy and completeness of, access to, and use of data in the automated system required by 453A of the Social Security Act.
